Your Complts Stith Tucker and Mary his wife formerly Mary Gilliam respectfully shew to the Court, That Thomas Gilliam the elder, departed this life some time in the year -- seized & possessed of a valuable estate real and personal in this County leaving a widow and four children to wit Thomas the father of your female Complt (who has also departed this life) John; Molly (who intermarried with Robert Tucker) and Lucy who intermarried with Richard Johnson. That the widow of the said Thomas Gilliam the elder was endowed of his estate, which portion is now subject to distribution, by the death of the said widow of Thomas the Elder. Your Complts claim a distributive share of the said dower real & personal, in proportion to the descendants of the said Thomas Gilliam the younger, who has departed this life intestate. ... he is the administrator with the will annexed of the said Molley Tucker ... He presents along with this bill a copy of the last will and testament of the said Mary by which it is shewn to the court, that the children of Thomas Gilliam the younger are entitled to that portion of the personalty and are residents of the State of Tennessee, and not within the jurisdiction of this court.

This day came the Complts by their counsel and it appearing to the satisfaction of the Court that the descendants of Thomas Gilliam the younger, as well as the legal representatives of Lucy Johnson and John Gilliam are not inhabitants of this Commonwealth, on motion of the Complts: It is ordered that the defts appear here on the first Monday in November next, and answer the Complts bill, and that a copy of this order be inserted forthwith for eight weeks successively in some newspaper ... and a like copy posted at the front door of the Court House of this County.
