Fry Carpenter's 1866 will excludes 'Lindsey Carpenter' BY NAME from 'my brother George F. Carpenter's children'. WHY THE 16 AUG GRADE CHANGED WITHOUT A NEW DOCUMENT - that grade applied the convention retired 3 Sep 2026, under which a link closed only on a record STATING the relationship; on that rule 'names Sally as George's wife, never as the mother' was correctly fatal. Under the proof standard adopted 3 Sep, ARGUMENT closes a link: two or more independent records, correlated, conflicts resolved. No new evidence was gathered. Full case: proof-summary-211-carpenter-mother-2026-09-04.md THE ARGUMENT - (1) WILL OF FRY CARPENTER, the children's paternal uncle, 8 Jan 1866 with codicils 1867-68: it devises 'six and one half shares to my brother George F. Carpenter's children', calls George F. 'their father', provides for 'his & Sally his wife's comfort', enumerates eight takers, and then names Lindsey TWICE to exclude him - 'To L. P. Carpenter I give not any thing' and, in the Jan 1868 codicil, 'Lindsey Carpenter is not to have any part thereof'. An express exclusion BY NAME from a defined class is an affirmative statement of MEMBERSHIP in it: a testator does not disinherit a person who could not otherwise take. (2) 1850 U.S. census, Smith Co., Tenn., NARA M432 roll 896 p. 336a line 37, dwelling 393 - George T[F] Carpenter 49, Sarah 44, 'Linzy' 24, and four younger children; six of six match F378. Lindsey at 24 is still resident with both. 1850 has NO relationship column, so this is co-residence, not filiation. (3) SIBSHIP CONTINUITY - F378's thirteen children run Jul 1824 to Mar 1852 with no gap; Lindsey is the SECOND, b. 5 Aug 1825, between Elizabeth Margaret (Jul 1824) and Lucy (Apr 1828). For Sallie not to be his mother, a first wife must have borne the 1824 and 1825 children and been replaced before Apr 1828, leaving no gap, no trace in any source, and no second family. (4) George F. Carpenter appears as father in EXACTLY ONE family in this database and Sallie as mother in exactly one; no rival wife has surfaced in any prior sweep. (5) TEXAS GLO, Fannin 1st Class file 1338, the 24 Aug 1867 Sweeney-certificate deed: it documents Sallie's marriage to George F. and names HER parents as Lindsey Powell and Margaret, late of Casey Co., Ky. So this son carries his maternal grandfather's full name - corroboration, not a pillar. THE RECORD - loose original will in [Original Wills]: Smith, Tennessee. County Court Minutes 1865-1869 p. 434 (ark 3:1:3Q9M-CSRV-L97Y-3): proved Monroe County Court, Kentucky, November Special Term 1868, certificate 9 Nov 1868, witnesses Abraham Jinkins and Christopher Hays. GRADE AND LIMITS - (1) NO record states that Sallie bore Lindsey. The link closes on correlation. (2) THE ARGUMENT'S REAL WEAKNESS: nothing brackets the 1823-28 window itself; the nearest independent record is the 1850 census, 25 years after the birth. Sibship continuity answers it, and that is DB structure rather than a document. (3) The F378 marriage event (2 Aug 1823) carries ZERO citations and is NOT counted as a record here; F378 also holds a second, uncited, internally impossible marriage event 'about 1832' - four children predate it - which is junk and must not be read as a competing marriage. (4) The 1867 GLO deed is an IMAGE-ONLY scan and was NOT re-verified on the images this session; a local image read is owed before the naming point is leaned on. (5) Variant readings unresolved: dateline county Ma[c/r]ion, Tenn.; Lucinda's married name Mins (loose will) vs Moore (minutes); sister Margaret's husband Campbell vs Carpenter. (6) Will pages 2849-57 largely unread - if they name the children's mother as someone else, this grade falls. (7) [1008] Christina, alive 1866, is absent from Fry's sibling bequests - unexplained, flagged. (8) [1010] Fry's recorded death place 'Grundy, Tennessee' (0 citations) sits against the Monroe Co., Ky. probate - reconcile research-first.
