PROOF CLASS: MOTHER = ARGUMENT (Owen graded 8 Sep 2026). Thomas Waring's 1803 will gives half his residue to "my sister Latane's children"; the 1812 Essex decree names her among the takers and divides Ann Latane's half "among her Children". AUDITED 8 Sep 2026 - her first. MOTHER = [56] ANNE WARING, on two instruments read on the manuscript, NEITHER OF WHICH ALONE SAYS "daughter". (1) WILL OF THOMAS WARING of St Anne's parish, Essex Co., dated 9 Oct 1803, proved 19 Dec 1803 - a court-certified copy inside the free LVA chancery scan of cause 057-1817-002: "I give to my two sisters Ann Latane & Susanna Lewis all my estate real & personal during their natural lives"; and "It is my will & desire that all the rest of my estate not heretofore bequeathed be equally divided at the death of my afsd two sisters Ann Latane & Susanna Lewis between all the children of my said two sisters that is one half to my sister Lewis's four children, John, Lucy, Warner & Joseph Jones Lewis & the other half to my sister Latane's children." The will DEFINES A CLASS and names the Lewis half individually. (2) THE 1812 DECREE in the same cause NAMES THE TAKERS. The plaintiffs include "Ann Latane, Susanna Lewis, Robert Payne Waring & Lucy his wife who before her marriage with the said Ro. P. was Lucy Latane, MARY TEMPLE WIDOW OF JOHN TEMPLE, WHO WAS BEFORE HER MARRIAGE WITH THE SAID JOHN MARY LATANE, Thomas Lewis Latane, William Catesby Latane, ... Susanna Latane, ... Elizabeth Latane, John Lewis and Joseph Jones Lewis"; and the court orders Ann Latane's half held "for her life only, and after her death to be equally divided among her Children". Citation C7004. ★ WHY THIS CLOSES: the will defines "my sister Latane's children" as a class taking a defined half; the decree enumerates the plaintiffs and orders the remainder to "her Children"; and she is identified inside that list BY HER HUSBAND, not by her name alone - so there is no namesake risk. Corroborated by Francis Waring's own 1770 Essex will (Will Book 12 pp. 431-433, read on the original register image, citation C6999) naming Ann Waring among seven children, and by the VMHB Latane pedigree, "1. Mary, married John Temple". ⛔ WHAT IT IS NOT: no single sentence in either document reads "Mary, daughter of Ann".
