Thomas Waring's 1803 will gives half his residue to "my sister Latane's children"; the 1812 Essex decree names her among the takers and divides Ann Latane's half "among her Children". PROOF CLASS: FATHER = UNDERDETERMINED (relabel 13 Sep 2026; flag 1 unchanged, Owen's). Nothing on record evidences this half; [55] carries 9 attached citations and 0 transcribed. Upgrades on the VMHB Latane pedigree naming Mary among his children. AUDITED 8 Sep 2026 - her first. MOTHER = [56] ANNE WARING, on two instruments read on the manuscript, NEITHER OF WHICH ALONE SAYS "daughter". (1) WILL OF THOMAS WARING of St Anne's parish, Essex Co., dated 9 Oct 1803, proved 19 Dec 1803 - a court-certified copy inside the free LVA chancery scan of cause 057-1817-002: "I give to my two sisters Ann Latane & Susanna Lewis all my estate real & personal during their natural lives"; and "It is my will & desire that all the rest of my estate not heretofore bequeathed be equally divided at the death of my afsd two sisters Ann Latane & Susanna Lewis between all the children of my said two sisters that is one half to my sister Lewis's four children, John, Lucy, Warner & Joseph Jones Lewis & the other half to my sister Latane's children." The will DEFINES A CLASS and names the Lewis half individually. (2) THE 1812 DECREE in the same cause NAMES THE TAKERS. The plaintiffs include "Ann Latane, Susanna Lewis, Robert Payne Waring & Lucy his wife who before her marriage with the said Ro. P. was Lucy Latane, MARY TEMPLE WIDOW OF JOHN TEMPLE, WHO WAS BEFORE HER MARRIAGE WITH THE SAID JOHN MARY LATANE, Thomas Lewis Latane, William Catesby Latane, ... Susanna Latane, ... Elizabeth Latane, John Lewis and Joseph Jones Lewis"; and the court orders Ann Latane's half held "for her life only, and after her death to be equally divided among her Children". Citation C7004. ★ WHY THIS CLOSES: the will defines "my sister Latane's children" as a class taking a defined half; the decree enumerates the plaintiffs and orders the remainder to "her Children"; and she is identified inside that list BY HER HUSBAND, not by her name alone - so there is no namesake risk. Corroborated by Francis Waring's own 1770 Essex will (Will Book 12 pp. 431-433, read on the original register image, citation C6999) naming Ann Waring among seven children, and by the VMHB Latane pedigree, "1. Mary, married John Temple". ⛔ WHAT IT IS NOT: no single sentence in either document reads "Mary, daughter of Ann". The father half [55] William Latane already read 1 and is untouched by this batch. 11 SEP 2026 - SHE ADMINISTERED HER HUSBAND'S ESTATE IN WOOD COUNTY, (W.)VA., AND THAT IS NOW CITABLE FROM THE MANUSCRIPT rather than inferred. [78] John Temple died there 20 May 1812 leaving four children under age, three hundred miles from Essex. (1) THE 1816 SETTLEMENT (Wood Co. Will Book 1A pp. 190-191, returned 1 July 1816; register K581, read on the image) is headed "The Estate of John Temple dec.d in a/c current with John Stephen[s], Nimrod Saunders and MARY TEMPLE, Administrators of the Deceased." The estate totalled $2,344, of which $847 is credited "By Do of Negro Slaves per bill"; no enslaved person is named on the page (ancestry/enslaved-people-named-in-temple-records.md). (2) THE 1828 SETTLEMENT (Will Book 3 @ 70, returned March term 1828; register K583) carries the commissioners settling "with MARY TEMPLE, adm[inistratrix]", then a receipt of 14 Sep 1826: "Received of HENRY W. LATANE Esq, agent for M.rs Mary Temple, Administratrix of John Temple dec.d ... after deducting a fee bill of fifty two cents due the Clerk of ESSEX SUPERIOR COURT." A Wood County settlement, paid through a Latane of Essex, costed against an Essex court's fee bill - the Essex tie stated by two institutions rather than by the decedent's own generic words. (3) The 1822 additional settlement (Will Book 2 p. 126, register K582) ties the chain arithmetically: it opens at $213.85 1/2, exactly the balance the 1816 commissioners struck. ⛔ WHAT THIS IS NOT: none of the three settlements names a child of hers. They are cash accounts between the estate and its administrators - creditors, attorneys and sureties - not distributions of property, and a "settlement" of this kind names kin only by accident (controls both ways, K583). This adds NOTHING to any parentage link, hers or her children's, and no proof flag moves. ⚠ "Henry W. Latane" (1828) and "W. H. Latane Adm.r" (1816, paid $505.95 out of the same estate) are DELIBERATELY NOT MERGED - one man transposed, or two. ADDED 11 SEP 2026 - THE FOUR PEOPLE WHOSE SALE SHE ACCOUNTED FOR ARE NOW NAMED. The 1812 inventory of her husband's estate (Wood Co. Will Book 1A pp. 122-125, taken 6 July 1812, read on the manuscript; register rows K596-K597) lists "(S/L)etty & Child (Nancy)" and "Nancy and Child (Tom)", each pair appraised at 300 dollars, 600 in all. The 1816 settlement she signed as administratrix credits 847 dollars for their sale and names no one. ADDED 11 SEP 2026 (afternoon) - THE FIRST NAME IS NOW RESOLVED: the ORIGINAL FILED INVENTORY, found in the Wood County loose court papers (DGS 008532161 image 57; register K600), reads "Letty and child (Nancy)". The basis is a letterform control from the same sheet in the same hand - the capital L of "Half of Large Keel boat", not the capital S of "2 Smoothing Irons". The clerk's recorded copy stays ambiguous and is not overwritten, and this is a reading with a stated control, not a regularisation. See ancestry/enslaved-people-named-in-temple-records.md. The same inventory shows what the estate she administered actually was: a STORE - 944 lb of coffee, salt by the bushel and in barrels, deer skins, nails, Hyson tea, "3 Funnels, Weights & Scales" and "1 Set Measures" - together with a half-share in a large keel boat and a skiff. She was administering a frontier trading business 300 miles from Essex, not a farm. Her husband owned no Wood County land (K579). ADDED 11 SEP 2026 (afternoon) - THE PAPERS OF THE ESTATE SHE ADMINISTERED ARE ON FAMILYSEARCH AFTER ALL. The Wood County LOOSE COURT PAPERS - a different holding from the courthouse will books, filmed from the originals at Morgantown - are digitised free: FS catalog koha:276505, "County court records, 1785-1875", 216 reels (K599). They carry the ORIGINAL filed 1812 inventory (K600, and see her husband [78]'s note) and two further Temple-estate papers which were OCR-ONLY when this paragraph was written and WERE OPENED ON THE IMAGE LATER THE SAME DAY (K601 is superseded; see K603 and K604): a declaration in debt for 200 dollars at the suit of Robert Tunstall, filed 1815-1816 IN THE SUPERIOR COURT OF LAW and reciting an obligation of "3rd day of October 1811" in John Temple's lifetime - EARLIER than the 1822 date this project had carried for that suit, and consistent with a store debt contracted while he lived; and the 1822 additional settlement, which on the original reads "Dr. John Stephenson Adm.r of Jn'o Temple dec'd - 1822 May 6th To balance due on last Settlem't - $213.85 1/2 - Cr - By Latane's Rec't for $50 - $50.00 - Personal services allowed by the C't - 50. - By Comm'n a[t] $5 p'r Ct on $2180.81 - 109.04 - Costs on suit Tinstall vs Temple's Adm'rs - 8.06 - $217.10". ⛔ CORRECTION, 11 SEP 2026 (evening) - THE OCR FIGURES FIRST ENTERED HERE WERE WRONG, AND THE MANUSCRIPT READINGS ABOVE SUPERSEDE THEM. This paragraph originally quoted the machine transcript as "By Comm 5 pr ct on $180.51" and "By Latance's Rect for $50", flagged as OCR strings not to be relied on. The images have now been read at native resolution (K604): the commission base is $2,180.81, NOT $180.51 - 5 per cent of 2,180.81 is the 109.04 actually written, where 5 per cent of 180.51 would be $9.03; the opening balance is $213.85 1/2, not "$50.00 ... $23.85 1/2"; the total is $217.10; and "Latance" is LATANE'S. "Stephenson" is CONFIRMED, and is JOHN STEPHENSON, spelled in full on three originals (K603, K604, K606) - he is a co-administrator with Nimrod Saunders and with her, as the 1816 header states. Every OCR caveat this paragraph set was correct to set. ⛔ THE LATANE OF THE 1822 RECEIPT HAS NO FORENAME AND NO INITIALS WRITTEN, so it does NOT resolve K583's "Henry W. Latane" (1828) against "W. H. Latane Adm.r" (1816) - do not merge them on the strength of it. ADDED 11 SEP 2026 (evening) - THE PAPERS THE CLERK COPIED ARE NOW READ, AND HER ADMINISTRATION IS DOCUMENTED FROM THE ORIGINALS. Registers K603, K604, K605, K606. THE ORIGINAL 1816 SETTLEMENT (K606; DGS 008420570, ark 3:1:3Q9M-CS1N-XLXD) confirms her on the paper the clerk was copying from, not merely in his copy: "The Estate of John Temple dec'd in acc't with Jn'o Stephenson, Nimrod Saunders and Mary Temple, Administrators of the [Deceased]". ★ AND THE CLERK'S COPY DROPPED THE CENTS: K581 read "$1,497.-" and a total of "$2,344"; the original reads 1497.66 1/2 and 2344.66 1/2, and the arithmetic then closes exactly - 1497.66 1/2 + 847.00 = 2344.66 1/2, less the 213.85 1/2 balance leaves the 2130.81 written as "To Amount bro't over". ⚠ SHE IS NOT A DEFENDANT IN THE 1815-16 SUIT, AND THAT IS RECORDED AS OPEN, NOT RESOLVED. The declaration in Tinstall vs Temple's Adm'rs (K603) names only "Jno: Stephenson and Nimrod Saunders, administrators of Jno: Temple dec'd", though K581's settlement returned 1 July 1816 names her one of three. Consistent with her qualifying later, with only the resident administrators being sued, or with her being in Essex and unserved. K583's 1828 wording phrases the two as separate administrations, which is suggestive and is not proof. ⛔ AND THE DATE OF HER QUALIFICATION CANNOT BE FIXED FROM THE FREE RECORD (K605). The probate clause at the foot of her husband's recorded will is the whole clause - the will is exhibited, proved and ordered recorded, and NOBODY QUALIFIES, NO BOND IS ENTERED, NO SECURITIES ARE NAMED. The grant of administration is therefore an ORDER-BOOK entry, and Wood County Order Book 1812-1817 is not on FamilySearch (K598). Controlled: on DGS 008532161, "administrator" 35 and "letters of administration" 23 against the must-miss control 0 - the corpus holds administration papers and does not hold this one; and the Wood County Clerk's own index (K579) lists five Temple documents and no bond. ⛔ AN OPEN ARITHMETIC QUESTION, RECORDED AND NOT EXPLAINED: the 1816 account carries $2,130.81 forward, while the 1822 settlement commissions on $2,180.81. The two bases differ by exactly $50.00, which is exactly the "Latane's Rec't for $50" credited in 1822. Suggestive; not proof; no document says the commissioners added the receipt back. ⛔ WHAT THIS ADDS TO ANY PARENTAGE: NOTHING. No child of hers is named on any of these papers, no proof flag moves, and no person is added for Stephenson, Saunders, Tunstall, Matthews, Taylor, Morres, Keigner or Foley.
